Texas Wrongful Death Attorneys

There are times that serious injuries result in  the death of a loved one.  There is no greater loss than those involving  a spouse losing their lifetime partner, parents losing a child, and children  due to the legal fault of another.   Ferguson Firm has represented children who have lost their parents, parents who have lost a child, and spouses who have lost their loved ones.   We will  treat you with the dignity, respect and honor to which you and your love one is entitled due to your loss.

Ferguson Firm is also committed to fully determine the causation of your loss, and obtain full justice for the survivors.   Timothy W. Ferguson has successfully tried and handled cases including the death of several  young children riding on a school bus who were killed by an  overworked 18 wheeler driver.  At the time of trial, this preventable incident  was the largest fatality bus wreck in United States history, and was a factor in the United States Department of Transportation of re-review its existing codes regarding driver fatigue.   Ferguson Firm has been able to get responsible defendants to change the manner and methods in which they continue their practice, including, for example, forcing a national company to comply with accepted national playground safety regulation or face Court sanctions.

While Ferguson Firm knows that nothing can be done to bring back your  loved one(s), we will make every effort to relieve the financial burdens and loss that these types of tragedies create.

Truck wrecks, oilrig explosions, and chemical exposure frequently lead to wrongful-death lawsuits

Our clients include the families or estates of people who have died in trucking accidents , on oilrigs, or because of cancer caused by chemical exposure . We also help families whose loved ones died in drunk-driving accidents or other motor-vehicle wrecks.

Ferguson Firm has represented numerous clients who have lost loved ones due to preventable truck wrecks, local plant incidents, including preventable explosions, and cancers caused by chemicals of which companies have known  for decades of their deadly potential.    The underlying problem which Ferguson Firm has discovered in its decades of legal practice stems from the decision made by some multi-million dollar companies to place "profit over people".   While there are some companies who truly put the safety of their workers as their priority, there are also irresponsible companies whom live by the creed that "if we find a cheaper way to do a job, and even lose a few lives, the cost of a lawsuit outweighs the profits that we can make".  Ferguson Firm takes on those types of companies who would rather make an extra nickel as opposed to ensuring the safety of the public.

In trucking litigation,   the DOT (Department of Transportation), sets out rules which both drivers and companies  must follow including hours on duty and vehicle inspection.  While many trucking companies strictly adhere to these minimum requirements, others have chosen to  ignore the safety regulations.    For example, Mr. Ferguson represented a man, was making in excess of $75,000.00 a year, who had  been married for well of 20 years.  He had 3 loving children.   One day, a fatigued driver who had been on duty operating an 18 wheeler for 17 consecutive,  and hit my client head on.  The company driver told the police officer at the scene that the was "just too tired".   My client survived, but sustained severe brain injuries.   He now works as a janitor making minimum wage.  There are days that he cannot remember his name.    Ferguson Firm obtained  a recovery during trial sufficient to assist this  family in their ongoing financial burden.

In plant explosion cases, OSHA (Occupational Safety and Health Assn.) has insufficient manpower to properly police daily actions of some chemical and refinery companies.   A simple failure to comply with the minimum standards set forth by OSHA was a cause of the recent British Petroleum explosion which led to many preventable deaths.    Ferguson Firm has learned that, unfortunately, the only color that some companies understand is "green".  Unless it costs them money (green) the companies  will continue to fail to protect injured workers.   Ferguson Firm stands rigidly in its determination to ensure that wrongdoers take personal responsibility for their failures.

Regarding chemical cancer litigation, the U.S. government has put out a list of "carcinogens" which are recognized to cause cases.   At the top of the alphabetical list is "asbestos", and insulating product which causes a variety of diseases, including a deadly form of cancer known as mesothelioma.   Every reputable scientist known to man agrees that the only known cause of mesothelioma is asbestos.   Unfortunately,   documents discovered through intensive discovery have shown that chemical/refinery companies knew as early as the early 1900s that asbestos caused cancer, but made a decision to not pass that on to their blue collar employees.    Mr. Ferguson is proud of the fact that he was a member of  the trial team which  tried the first asbestos class action case resulting in a final judgment in the approximate amount of 1 billion dollars.
